Men's Best Ambassador Program Terms & Conditions

The Program lets selected creators produce short video content (“Content”) featuring Men's Best products and share it using a unique affiliate link and/or discount code. Men's Best may also run selected Content as organic or paid advertising. Participating creators earn a commission on the sales they generate.

You may participate only if you are 18 years of age or older, and by participating you represent that you are.

We may update these Terms from time to time; where we make material changes we will give reasonable advance notice, and your continued participation after the changes take effect constitutes acceptance of the updated Terms.

Upon acceptance into the Program, Men's Best provides you with a unique affiliate link and/or discount code (your “Affiliate Link”). You earn a commission of twenty percent (20%), up to thirty percent (30%), of the GMV of purchases made through, or otherwise attributable to, your Affiliate Link or your Content (the “Commission”).

“GMV” (Gross Merchandise Value) means the gross value of goods of all completed and paid orders attributed to your Affiliate Link or your Content, excluding shipping and taxes, and less returns, cancellations and cancelled or fraudulent orders. Attribution is determined by our tracking systems.

Commission is paid in accordance with our then-current payment practices, of which we will give you reasonable notice. You acknowledge that the Commission is your sole compensation for participating in the Program, and that you have no entitlement to any further consideration in cash or equity.

Only one participant profile and one Affiliate Link is permitted per person; applying for more than one is grounds for termination.

By uploading Content to the Program, you grant Men's Best a worldwide, perpetual, irrevocable, transferable and sub-licensable licence to use, host, edit, adapt, reproduce, distribute and publicly display that Content, and to run it as organic or paid advertising on any and all channels — including but not limited to TikTok, Meta (Instagram/Facebook), YouTube, other social platforms and our website — including delivery through your own accounts (e.g. Spark Ads / whitelisting). This licence includes the right to use your name, handle, voice and likeness in connection with the Content and its promotion, and continues after your participation in the Program ends. To the extent permitted by law, you waive any right to be credited as the author.

You represent and warrant that the Content is created by you, that it infringes no third-party rights, and that you hold all necessary rights to any music, trademarks and logos used and have obtained all required consents from persons shown (model releases) and locations depicted.

You will follow the Creative Brief, join and monitor the Program platforms we invite you to (e.g. Trybe), and clearly label advertising Content as such (e.g. “advertisement” / “#ad”) in accordance with applicable advertising and consumer-protection law and the relevant platform guidelines. You will make only truthful and substantiated claims about our products.

You will not:

• publish your Affiliate Link on public coupon, deal or discount sites, in forums (e.g. Reddit) or via search engines;
• bid on Men's Best brand keywords on search engines or advertising platforms (brand bidding);
• use self-purchases or test orders to generate Commission (self-referral);
• re-use Men's Best's original content, or another creator's content, without our prior consent;
• apply for or use more than one Affiliate Link;
• make unsubstantiated, misleading, abusive, harassing, hateful or unlawful statements in connection with the Program.

No Commission arises on any transaction generated in breach of this Section E, through fraud or through self-referral. A breach may also lead to deactivation of your Affiliate Link and termination of your participation for cause. Commission you have already lawfully earned is not forfeited.

You represent and warrant that: (a) you are 18 or older; (b) you have the legal right and authority to enter into these Terms; (c) your participation will not violate any applicable law or any agreement with a third party; (d) you will not infringe the intellectual property, privacy or publicity rights of any third party; and (e) your Content and conduct will not be abusive, harassing, defamatory, obscene, hateful, misleading or otherwise unlawful.

The Program is non-exclusive. You are free to create Content for other brands, including competitors, and you are not bound or locked in to Men's Best. You may leave the Program at any time. Men's Best may likewise engage other creators.

These Terms apply from the moment you are accepted into the Program until your participation ends. Either party may end participation on reasonable notice; we may end it immediately for cause, including a breach of Sections C, D or E. On termination, we will provide a final Commission statement and pay Commission lawfully earned up to that date in accordance with our payment practices. The licence granted in Section C, and Sections E, F, I, J, K and L, survive termination.

You will keep confidential, and use only to perform under these Terms, any non-public information of Men's Best made available to you (including information about products, marketing, and upcoming drops or restocks). This does not apply to information that is publicly known, was lawfully obtained from a third party without breach of a confidentiality obligation, or is part of your general knowledge and skill.

You will not make public statements about Men's Best, its products, employees or business practices that are untrue or intended to damage its reputation. Your right to make truthful, factual criticism and to leave lawful reviews is unaffected.

You will indemnify and hold harmless Men's Best, its affiliates and their representatives from and against any third-party claims, losses, damages and reasonable costs (including reasonable legal fees) arising from your breach of these Terms or your representations and warranties, or from your Content. In all other respects the liability of the parties is governed by the applicable statutory provisions.

Independent contractor. You participate as an independent contractor. These Terms create no employment, agency, partnership or joint-venture relationship, and you are solely responsible for your own taxes and any social contributions and, where applicable, VAT.

Data protection. We process personal data in accordance with the GDPR and our privacy notice.

No publicity. Other than promoting the Content itself, you will not issue any press or public statement about a formal association with Men's Best without our prior written consent.

Amendments; severability; waiver. Changes to these Terms are made in accordance with Section A. If any provision is found invalid, the remaining provisions stay in force and the invalid provision is replaced by one that most closely reflects its intended purpose. Our failure to enforce a provision is not a waiver of it.

Governing law & jurisdiction. These Terms are governed by and construed in accordance with the laws of the Netherlands. The courts of the city of Amsterdam, the Netherlands, have exclusive jurisdiction, to the extent permitted by law.

Entire agreement. These Terms are the complete agreement regarding the Program and supersede any prior understandings relating to it.
